TERMS AND CONDITIONS
- Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions
- Entry is only open to Australian residents aged 13 years or over. Employees (and their immediate families) of the Promoter, and agencies associated with this promotion are ineligible.
- "Promotion Period" means the period commencing on 10/04/2008 and closing at 4pm AEST on 18/08/2008. "New Members" mean eligible entrants who become 'Make Every Drop Matter' members during the Promotional Period. "Existing Members" mean eligible entrants who became 'Make Every Drop Matter' members before the Promotional Period.
- New Members are eligible to receive entries in both the Minor Prize Draws and Major Prize Draw. Existing Members are only eligible to receive entries in the Major Prize Draw.
- New Members
To receive an automatic entry, entrants who are not Existing Members, must visit www.makeeverydropmatter.com.au during the Promotional Period and become a ‘Make Every Drop Matter’ member by following the prompts to the new member page and inputting the requested details. Upon completing the above process, New Members will receive one (1) entry into the relevant Minor Prize Draw (according to when their registration is completed, if any remain open) and one (1) entry in the Major Prize Draw.
- To gain additional entries, a New Member may refer the competition to a friend via email by clicking on the 'refer a friend' link and inserting the requested details of their friend, including their email address. New Members may refer up to 20 friends provided they are an Australian or New Zealand resident aged 13 years or over and who would normally consent to receiving such a message from the New Member. The New Member who refers their friend will receive one (1) entry into the relevant Minor Prize Draw (according to when their registration is completed, if any remain open) and one (1) entry in the Major Prize Draw when their referred friend becomes a 'Make Every Drop Matter' member. The New Member will receive no additional entry if their referred friend is already a member.
- Existing Members
Existing Members will automatically receive one (1) entry in the Major Prize Draw, and will be advised of this by email.
- To gain additional entries in the Major Prize Draw, an Existing Member may refer the competition to a friend via email by clicking on the 'refer a friend' link and inserting the requested details of their friend, including their email address. - The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these conditions of entry or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
- Incomplete, indecipherable or illegible entries will be deemed invalid.
- Entries close at 11:59pm for each draw on the dates and times specified in the table below. All draws will take place at Anisimoff Legal, Suite 1, Level 1, 34 Chandos Street, St Leonards, NSW 2065 at 4:00pm AEST on the dates and times specified in the table below. All times indicated are Sydney Local Time. Winners will be notified by mail and winners of prizes valued at over $100 will have their names published in The Australian on the dates specified in the table below. Winner’s names will also be published on the 'Make Every Drop Matter' website on 25/08/2008. Entries in each Minor Prize Draw will NOT be entered into any subsequent Minor Prize Draws. The Promoter’s decision is final and no correspondence will be entered into.

- The first 10 valid entries drawn in each of the Minor Prize Draws will each win the Minor Prize of a 'Wii Sports package' valued at AUD$500. Each Wii Sports package includes a Nintendo Wii console, a Wii sports games & an extra Nintendo Wii control.
- The first valid entry drawn in the Major Prize Draw will win the Major Prize of a trip for 2 adults and 2 children (aged 18 years or under) to Phuket, Thailand valued at up to AUD$14,500 including GST. The Major Prize includes: return economy airfares flying Thai Airways, from the winner’s nearest capital city to Phuket, Thailand, private car transfers, 6 nights twin share accommodation at Sheraton Laguna Grande Resort, Phuket, Thailand, A Nga Sea Canoe tour, Elephant Trek & Rafting, Jungle Safari and Khao Sok Tour, and travel insurance for 8 days on Plan 1, Area 3 provided by Covermore Travel Insurance. Spending money, meals, taxes, additional insurance, transport to and from departure point, additional transfers, items of a personal nature (including but not limited to additional room charges such as pay per view movies, laundry, room service, telephone calls), any upgrades or additional nights and all other ancillary costs are not included and are the responsibility of the winner..
- Major Prize should be taken by 18/08/2009 and is subject to booking and flight availability. The Major Prize may be taken after the date as specified above, however any costs in addition to the total prize value will be the responsibility of the winner.
- During the entire duration of the Major Prize, any person under 18 years of age must be accompanied by their nominated parent(s) or legal guardian(s). The winner (and any companions) must depart from and return to the same point of departure and must travel together. Frequent flyer points will not form part of the Major Prize. The winner may be required to present a credit card at the time of accommodation check in.
- If for any reason a winner does not take the Major Prize or an element of the Major Prize at the time stipulated by the Promoter, then the prize or that element of the prize will not be redeemable for cash.
- The next 30 valid entries drawn in the Major Prize Draw will each win a "Rebel Sports Gift Card" valued at AUD$100 each
- Any ancillary costs associated with redeeming the Rebel Sports Gift Card are not included. Any unused balance of the Rebel Sports Gift Card will not be awarded as cash. Redemption of the Rebel Sports Gift Card is subject to any terms and conditions of the issuer including those specified on the Rebel Sports Gift Card.
- If the winner of the first Major Prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian.
- Total prize pool value is up to AUD$32,500. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
- The Promoter may conduct such further draws at the same time and place as the original draw, as are necessary on 19/11/08 in order to distribute any prizes unclaimed by that date, subject to any written directions from a regulatory authority. In the event of any winners, their names will be published in The Australian on 26/11/08. Winner's names will also be published on the ‘Make Every Drop Matter’ website on 25/11/2008.
- If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of prize) with a prize to the equal value and/or specification, subject to any written directions from the a regulatory authority.
- If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
- Any costs associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used. Any contact details entered incorrectly on the website shall render an entry invalid. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
- Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
- 26. All entries remain the property of the Promoter. The Promoter collects entrants' personal information in order to conduct the promotion. If the information requested is not provided, the entrant may not participate in the promotion. Entrants' information will also be used in accordance with the Make Every Drop Matter member privacy policy available at www.makeeverydropmatter.com.au. Entrants' personal information may be disclosed to State and Territory Lottery Departments and winners' names published as required under the relevant lottery legislation. A request to access, update or correct any information should be directed to the Promoter at their address set out below.
